In the video below you see a man tell the officers arresting him for public intoxication (another victimless crime), “Don’t fucking handle me like that.” At that point one of these officers slammed Nathan Barton to the ground, knocking him out cold. See for yourself.
That officer’s name is David Schmindt Jr., who has since resigned from the Spotsylvania County Sheriff’s Office and is now being charged with misdemeanor assault and battery in a local court. According to the The Free Lance Star:
Special prosecutor Thomas Johnson from Henrico County will be taking over the case, according to Spotsylvania Commonwealth’s Attorney Bill Neely. He said the video was included as part of the evidence that was turned over to Henrico authorities.
The charge stems from a March 25 incident in which deputies responded to a 911 call about an unruly customer at the Four-Mile Fork Shopping Center ABC store, according to sheriff’s Capt. Jeff Pearce.
Nathan Anthony Barton, who was charged with being drunk in public, resisted being taken into custody by the responding deputy, Pearce said. Schmidt came to the scene to help the other deputy, he said.
According to Pearce, Barton became unruly a second time and alleged that Schmidt threw him to the ground.
A woman who was traveling with Barton recorded the incident with her iPad.
Family members of Barton provided The Free Lance–Star with the video on Wednesday.
The one-minute, 16-second video does not show what led to the arrest, but Barton can be heard saying, “What did I do?” and “Don’t [expletive] handle me like that” before he is thrown to the ground with his face hitting the pavement.
Pearce said Schmidt’s alleged action is a violation of policy and was deemed inappropriate by the Commonwealth’s Attorney’s Office.
Spotsylvania’s criminal investigative division investigated the incident and presented the results to the Spotsylvania Commonwealth’s Attorney’s Office. The commonwealth’s attorney had the case independently reviewed by the Henrico Commonwealth’s Attorney’s Office and they both agreed to charge Schmidt with one count of misdemeanor assault and battery, Pearce said.
Well, I’m sure most readers are thinking what I’m thinking… gosh damn! In the police state of the USSA you can choke a man to death on video and not be charged, yet if you slam a guy on the pavement you will not only be charged, but forced to resign your position as well. I’m not saying that this officer shouldn’t be punished, I’m merely pointing out that it seems to be a case of actual reasonable punishment, while so many others are not. There’s no consistency in police punishing police, other than that it rarely happens, but I guess we can applaud (like a golfers clap) that this particular case of police abuse was handled appropriately.
