The Victorian Labor Party could face criminal charges if it refuses to hand over media plans devised by the former Brumby government, Premier Ted Baillieu says.
The coalition government is serving the Labor Party with legal documents on Friday requesting it hand over the media plans following a ruling by the Victorian Civil and Administrative Tribunal (VCAT).
Mr Baillieu said the opposition could have broken the law if it had destroyed the documents.
“The Crimes Act does deal with the issues associated with the handling of documents which are subject to legal action,” Mr Baillieu said.
The coalition freedom of information request for the documents followed the accidental release of a media plan for former planning minister Justin Madden, which outlined a bogus public consultation process for the Windsor Hotel redevelopment.
Mr Baillieu said the coalition had 50 fewer ministerial staff than the former Labor government.
“We don’t have the sort of media plans to which reference have been made,” he said.
Comment was being sought from the opposition.
