An unlicensed driver who killed his friend in a crash during a police pursuit in Melbourne’s southeast has been jailed for at least three-and-a-half years.
Carlos Lucky, 23, had been drinking and smoking cannabis before he stole a car and sped away from police when they tried to pull him over in Dandenong in January.
His 19-year-old friend, Luka Deng, was in the passenger seat when Lucky sped through two red lights, reaching speeds up to 140km/h, before losing control of the car as he swerved to avoid a turning truck.
The car slammed into a roadside guardrail, killing Mr Deng.
Sentencing Lucky in the Victorian County Court on Thursday to a maximum of six years, Judge Felicity Hampel said: “There is no excuse for driving at highly dangerous speeds, there is no excuse for not pulling over when required to by police.”
Lucky, who pleaded guilty to culpable driving and car theft, must serve three years and six months before being eligible for parole.
Speaking outside court, Mr Deng’s uncle, Gah Deng, said while his family were loving Christians who could forgive Lucky, they felt his punishment was too light.
“We think Mr Lucky should have received a greater sentence, because we will never get Luka back,” Mr Deng told reporters.
“We accept his apology because it seems that it was an accident.”
Mr Deng described his nephew’s death as “a big loss for the family”, and said he was missed every day.
Luka Deng’s mother, Ihssan Mursan, who brought Luka and his siblings to Australia from Sudan when they were children in search of a better life, clutched a photo of him and said: “I love my son very much”.
Detective Sergeant Rohan Courtis said Mr Deng’s death was a tragedy that could have been prevented, and that Lucky’s “selfish behaviour” should be a warning to all drivers.
“Any matter like this where we’ve got drugs, alcohol, speed and unlicensed driving, is always going to end in tragedy,” he told reporters.
