Samsung Angers Court by Releasing Excluded Trial Documents

Disappointed with the court’s decision to exclude evidence that Apple borrowed from Sony for its iPhone design, Samsung decided to release the documents to the public.

“The Judge’s exclusion of evidence on independent creation meant that even though Apple was allowed to inaccurately argue to the jury that the F700 was an iPhone copy, Samsung was not allowed to tell the jury the full story and show the pre-iPhone design for that and other phones that were in development at Samsung in 2006, before the iPhone. The excluded evidence would have established beyond doubt that Samsung did not copy the iPhone design. Fundamental fairness requires that the jury decide the case based on all the evidence,” said Samsung in a statement.

Samsung has made public two Powerpoint presentations totaling nine pages, showing that its F700 phone predates the iPhone by a couple of months. These files also show that former Apple industrial designer Shin Nishibori was asked by Apple’s design chief Jonathan Ive to create a phone inspired by Sony’s idea of a keyboard-less, touch-screen phone.

Samsung’s decision did not sit well with Apple, whose legal team called the action “contemptible,” nor with Judge Lucy Koh, who called for an immediate meeting with Samsung’s lawyer John Quinn.

The patent trial resumes in federal court in San Jose, Calif., on Aug. 3.
