Georgia’s recent Street Gang Terrorism And Prevention Act was used to charge members of a racist group that made terrorist threats during a July confrontation at a black child’s birthday party.
The incident occurred on July 25th and was recorded on cell phone. A caravan of at least four pickup trucks, each flying Confederate flags, drove pass a party in Douglas County, GA. A woman’s voice is heard on the video shouting, “This is a child’s birthday party!” The passengers yelled racial slurs at the party attendees. According to the party’s hostess, Melissa Alford, one of the passengers who had a gun said he was “gonna kill the n-ggers.” Then another of the passengers said, “gimme the gun; I’ll shoot the n-ggers.” The group, known as “Protect The Flag”, provoked an altercation with the residents and each side accused the other of throwing projectiles at them.
Levi Bush, leader of the Protect The Flag group, initially said he and his colleagues “drive around and sell flags”, that his group was threatened by the partygoers, and that he and his friends had to hold off a group of “15 or 20 of them.”
Bush and 14 other members of his group were subsequently charged with two counts under the recent Street Gang Terrorism And Prevention Act. Each count is a felony. One carries a maximum sentence of 15years and the other carries a five year maximum sentence. The law is aimed at helping prosecutors establish criminal links between gang members and making terrorist threats.
