A Perth settlement agent has been fined $5000 for breaching the Settlement Agents Act.
Mount Claremont settlement agent Collette Ockerby, who trades as Cally’s Conveyancing, has been fined $5000 and ordered to pay costs of $500 by the State Administrative Tribunal (SAT).
The Commissioner for Consumer Protection took disciplinary action against Ms Ockerby following the settlement of a unit in Mosman Park, in Perth’s western suburbs in January 2009.
Ms Ockerby admitted to 12 breaches of the act and agent’s code of conduct including failure to obtain written consent from both the joint owners of the property and not paying funds received from one client into a trust account as soon as practicable.
Consumer Protection acting commissioner Gary Newcombe said the penalty highlighted the risk settlement agents took if they did not comply with the law and the Code of Conduct.
“It’s essential that settlement agents comply in every detail with the act and code of conduct when completing documents, preparing correspondence and handling their clients’ funds from property transactions,” Mr Newcombe said.
The SAT orders were handed down on December 23.
