A morbidly obese woman who claims she cannot get out of bed unaided went to see chart-topping boy band ‘The Wanted’ in concert, the High Court heard.

The woman claims her condition means her local council should provide her with someone shopping for her and wash, feed and clothe her.

She also said she needs council staff to take her to the gym and when ‘she goes to a disco on Friday nights’, the High Court was told.

But Plymouth Council, contesting her demand that they provide her with 50 hours of care each week, said her dependence on the state was actively harming her.

The council told a senior judge the woman managed to attend on her own a concert by the British and Irish heartthrobs ‘The Wanted’ in April – who hit number one last year with Glad You Came.

Plymouth also rejected the woman’s claim she cannot buy food on her own – arguing she manages to buy cigarettes and alcohol unaided.

And rather than being incapable of operating a washing machine, she can operate ‘far more complex equipment’ namely computer game consoles, it argued.

The council said she can also ‘make choices’ about her diet and buy low fat ready meals recommended by her ‘weight management’ programme.

It said she has become ‘emotionally and psychologically dependent’ on council-funded support.

The council said it was a consultant psychiatrist’s view that she needs to ‘take responsibility for her own life and break her reliance on the support of others’.

The council added that too much care and support from others will be ‘counter-therapeutic’ and ‘detrimental to her well-being’.

Irena Sabic, for the woman, said she has a history of self-harm and drug overdoses and her care needs were recognised by the council until May last year, when ‘direct payments’ – enabling her to live in a supported home – were withdrawn.

Miss Sabic said that her client was so paranoid that she cannot take a bath, without a ‘trusted’ person keeping watch outside the door.

At one stage, the woman did not wash herself for months on end.

Miss Sabic said her client was ‘in desperate need of support’ and accused the council of failing to lawfully assess the woman’s community care needs and provide the help she requires to have a reasonable quality of life.

And she disputed council arguments that the woman ‘requires no care services whatsoever, that she’s over-reliant and it’s a question of choice’.

James Dixon, for Plymouth, said an ‘impasse’ had developed, with the woman and the council taking diametrically opposed views on the amount of help she needs.

He claimed the woman had often failed to ‘engage’ with council offers of support and told the court: ‘The key question is her willingness to take responsibility for her own personal care.’

In a preliminary ruling, Judge Stephen Males QC said there was ‘complete disagreement’ between the woman and the council over the level of care she needs.

However, he said the council’s assessment of the woman’s requirements was ‘arguably unlawful’ and ordered Plymouth to put in place a regime to cater for her ‘immediate and urgent’ needs pending the full hearing of her judicial review.

The ruling means the council must lay on support workers to help the woman wash herself, cook and clean her flat and to accompany her to the shops.

But the judge stopped short of ordering the council to provide chaperones when the woman attends the gym or Friday night discos.

Stressing that he was in no way pre-judging the issues in the case, the judge said the council’s position ‘may ultimately be vindicated’.

The full hearing of the woman’s case is now expected to take place in May this year.

Cannot believe I have read this story….Am glad the council is contesting this, but how long before infringing this womans human rights come into it??

Time to cut back on her social care. She’s obviously taking the mickey. The social departments are to frightened to tell the truth because of lawyers etc who jump on the band wagon (at my expense). These lawyers are to blame when they advertise ‘ No Win No Fee ‘ Of course nothing will happen because, government are run by lawyers and doctors.

I am disabled and in severe pain all the time…when I asked for support with my housework I was told it was ‘not provided’ by the council. I was, however, offered someone th come in and help me prepare an evening meal (I have a snack) and for this I would have to pay £80.00 per month + private payments for housework support roughtly £240 per month. i see if you overeat its a different story!

Pure laziness. How have her demands managed get so far as to waste so much of other peoples time and tax payers money? She is a joke, and the people responsible for pandering to her petty ‘me me me’ requests are an even bigger joke.
And how can she manage to afford concert tickets and trips to this disco? Wish I could…

And thanks to the LabDimwits the lefty labour party and the out of touch clerics voting against benefit caps things will never change!!

These lazy fat people should be made to attend a rehab thing and get them selves sorted once and for all! By paying her money and giving her free care is a joke, there is old people in this country who can not afford to heat their homes, children who live on the breadline, jobs being cut all over, money spent facilitating this women could spent on these worthy things! This the underlying problem in the UK it’s better to be a sick person and claim your ill cause your fat! I understand she suffers from mental health issues but the judge was right by allowing this to go will just her worse, the biggest joke of all is how she can pick and choice what she can do and what she can’t surly going to the Wanted is just the same as going to the shops yourself, can’t make choices that are healthy she has a list from yet another person caring for her telling her what to buy!!!My advice put the pie down, give up the fags and booze then maybe she would be able to conduct herself like the rest of us!
