A homeowner who stabbed an intruder to death in southwest Sydney could escape prosecution with police to recommend no charges.
Donald Brooke, 54, was confronted in the lounge room of his Yagoona home in September last year by a man armed with a stun gun.
After a scuffle, Azzam Issam Naboulsi was stabbed in the chest and arm, police say.
The 30-year-old career criminal was seen bleeding to death in the street as his 26-year-old accomplice drove away.
Police had initially told Mr Brooke he faced a manslaughter charge for fatally wounding Naboulsi.
But News Ltd reports that senior police have indicated they will recommend to the coroner that no charges be laid against Mr Brooke because he acted in self-defence.
This followed a long investigation.
