Man jailed for bashing mate’s tormentor

A man who fractured a medical student’s jaw in a fight sparked by racial taunting will spend the next four months behind bars.

Adrian James Embrey, 23, was sentenced in the District Court in Brisbane on Thursday after pleading guilty to grievous bodily harm.

The court was told a fight erupted between a Sri Lankan Tamil friend of Embrey and one of the friend’s medical school classmates at a party in Townsville on April 10, 2009.

Embry’s barrister Josh Fenton told the court the classmate had been taunting Embry’s friend at a medical school camp a few weeks earlier about the defeat of the Tamil Tigers, which ended Sri Lanka’s civil war in early 2009.

Embrey’s friend had confronted his classmate at the party over the racial taunts and was punched. Several people, including Embrey, then became involved.

Embrey punched the victim in the back of the head and then at least once more in the face, causing his jaw to shatter in several places.

The man needed several operations to fix his jaw and still requires surgery to fix his vision.

Judge John McGill agreed with prosecutor David Nardone’s submission that a prison sentence was appropriate due to the severity of the injuries.

“Overall, it was a vicious, unnecessary and inappropriate attack without warning on someone who was not really in a position to defend himself,” Judge McGill told Embrey.

He sentenced Embrey to 18 months’ imprisonment but ordered the term be suspended for two years after he serves four months behind bars.
