The only adult in a Kings Cross joy-ride that ended with police shooting two teenagers has been refused bail in a Sydney court.
Matthew Dalton, 24, appeared in Central Local Court on Friday via an audio-visual link on a charge of being a passenger in a stolen vehicle that triggered a dramatic police shooting last Saturday.
In refusing bail, Magistrate Janet Wahlquist said she agreed with police concerns that Dalton could offend again.
“The circumstances of the offence are serious,” Ms Wahlquist told the court.
“I think if convicted, he would be serving a jail sentence.”
Dalton and five boys, the youngest aged 13, were travelling in a stolen Honda Civic on Darlinghurst Road when it mounted the footpath in an attempt to evade police, mowing down two pedestrians.
Two officers fired multiple shots into the car, wounding the 14-year-old driver and the 17-year-old front-seat passenger.
Dalton, who was in the back seat at the time, has plead not guilty to the charge, claiming he did not know the vehicle was stolen.
His lawyer told the court that Dalton’s partner of six months had offered to pay a surety of $300 to secure his bail.
“That amount is a lot of money for her,” Dalton’s lawyer said.
“She is a single parent.”
The court heard Dalton also had a one-year-old daughter who is in the care of the Department of Community Services.
Dalton would remain at his Whalan government housing unit in western Sydney and only leave to report to Mt Druitt police station, his lawyer said.
He would also be prohibited from consuming alcohol.
Court documents state that Dalton told police he had consumed more than 20 alcoholic drinks and smoked cannabis before the incident.
He has also had past issues with alcohol, cannabis and ice, the court heard.
Police prosecutor Peter Bain opposed bail, saying Dalton had prior criminal convictions over similar matters and was a threat to the community.
The matter was adjourned until June 8.
