A court in Perth has been told that three Indonesian men on trial over people smuggling acted as crew on a boat carrying 89 asylum seekers to Christmas Island.

The boat sank in heavy seas in December 2010 but the jury has been told the fate of the vessel was irrelevant to the case, which relates only to allegations of people smuggling.

In his opening address, prosecutor Ron Davies QC said evidence would show the three men, Abdul Rasjid, Supriyadi and Hardi Hans, helped bring the asylum seekers to Australia knowing the action was illegal.

The court was told one of those on board, an Iranian man, paid thousands of dollars to buy fake documents and passage on the boat.

Speaking through an interpreter, the Iranian man said he paid $6,000 to buy false papers and another $1,000 when he arrived in Indonesia.

He said during the three day voyage, he had seen the three Indonesian men steer the boat and provide food and water to the passengers.

The three have been charged with assisting the arrival of asylum seekers in contravention of the Immigration Act.

The defence has told the jury there is no evidence to suggest one of the accused was responsible for organising or co-ordinating the operation.

Rasjid’s lawyer, George Christou, said the case against his client rested on whether Rasjid had taken action to assist the asylum seekers knowing their destination was Australia and the action was illegal.

He said there was no evidence to suggest his client had approached the asylum seekers, sourced or outfitted the boat, or been paid hundreds of thousands of dollars by the passengers.

All three have pleaded not guilty to the charges.

The trial is expected to run for three weeks.
