Guard could stop senator, court told

A supermarket security guard had the power to intercept South Australian Liberal Senator Mary Jo Fisher for allegedly stealing food, police have told an Adelaide court.

The senator went on trial in Adelaide Magistrate’s Court last week accused of stealing $92.92 of food from a Foodland store last December and assaulting the security guard, Cathryn Groot, who tried to stop her leaving.

The senator, 48, has pleaded not guilty to the charges.

Her defence counsel, Michael Abbott QC, told Magistrate Kym Boxall last week Ms Groot overstepped the powers of her security licence, her evidence should be excluded and she should be warned she could face criminal charges.

Magistrate Kym Boxall adjourned the matter while police sought advice.

Back in court on Wednesday, police prosecutor Brendon Beh agreed Ms Groot’s licence was restricted but said she had done nothing unlawful.

Ms Groot’s licence empowered her to leave a store, go into the car park and ask someone to return to the shop, he said.

“If the person being asked to go back has property that they shouldn’t have, then yes,” Sergeant Beh said.

Mr Abbott reiterated his belief that Ms Groot should be “generally warned” she didn’t have to answer questions that may tend to incriminate her.

Claiming to have powers she didn’t have could attract a $20,000 fine, he said.

Magistrate Boxall said he would consider the matter overnight and adjourned the court until 10am (CST) on Thursday.

Ms Groot intercepted Ms Fisher in her car after watching her leave the Adelaide store last December with fruit and vegetables in her personal trolley that she had not paid for, the court heard last week.

Ms Groot said she did not know who the senator was when she took her back to the supermarket office or when the senator pushed her away as she tried to get into her car and leave.

The court also heard the security guard sought, reluctantly, to drop the charges after an approach from representatives for Ms Fisher.

Mr Beh also said CCTV footage of the incident had been erased before police claimed it.

Mary Jo Fisher has been a senator since being elected in 2007 following the resignation of Amanda Vanstone.

She made headlines when she danced the Hokey Pokey and The Time Warp in the Senate in March this year to mock the government’s policy on climate change.
