GINA Rinehart has a date with a Sydney court, with a court told this morning the country’s richest person will likely be called to give evidence in the bitter trust dispute with her two eldest children.


The family feud over the Hope Margaret Hancock Trust has now played out in the NSW Supreme Court for 18 months, but a judge has this morning scheduled the case for one week hearing, to begin on October 1.

The court heard Mrs Rinehart will likely “be required to attend for cross examination.”

She is being sued by her two eldest children, John Hancock and Bianca Hope Rinehart, who want her removed as head of the family Trust amid allegations of “serious misconduct.”

Her third child, daughter Hope, had originally been on the same side as her siblings but the court heard last month she had to pull out due to financial trouble.

The youngest Rinehart child, daughter Ginia, took her mother’s side in the dispute shortly after the case was lodged in September 2011.

The court heard today there has been suggestion that a “non family member” could be appointed as trustee.

The trust, established by Mrs Rinehart’s father Lang Hancock, holds about 23.45 per cent of the shares in Hancock Prospecting.

Lawyers for Mr Hancock and Bianca Rinehart were told they must notify Mrs Rinehart’s side if “they seek to have a non family member as trustee”, so that the case could return to court before the main hearing.

Evidence from both sides will have to be filed by June 17.

There will be a directions hearing on May 8.
