Dominique Strauss-Kahn’s lawyers argue he was protected by diplomatic immunity

For Miss Diallo, Douglas Wigdor said however: “Strauss-Kahn doesn’t have
immunity, and Miss Diallo is going to get her day in court.

“DSK thinks he can unilaterally, himself, in his own personal capacity,
assert diplomatic immunity and not be held accountable for his actions.”

Bronx state Supreme Court Justice Douglas McKeon did not make an immediate
ruling, but said he would decide on the case “expeditiously.”

Mr Strauss-Kahn was travelling on an IMF diplomatic passport when he was
arrested on the tarmac as he was about to fly out of New York, after Miss
Diallo claimed that he had sexually assaulted her in his hotel room.

The IMF has said that he is not protected by the document, because he was not
travelling on official business at the time of his arrest.

Judge McKeon asked the defence team why Mr Strauss-Kahn had not used the
diplomatic immunity claim during his criminal case.

Mr Mehta said: “He’d been falsely accused of something he hadn’t done, and
it wasn’t in his interest to raise a defence that might seem purely
procedural. It was in his interest to fight those charges.”
