Deadly drug-drive hairdresser jailed

A Victorian hairdresser who killed a woman when he crashed into her car while under the influence of cannabis has been jailed for three years.

Jonathan Palcak, 27, and his victim’s family wept upon hearing he would spend a minimum 18 months in jail over the death of 57-year-old mother Cheryl Wallis.

As she was leaving the Victorian County Court room, Ms Wallis’ sister told Palcak’s family she hoped they would pay for her sister’s death for the rest of their lives.

Ms Wallis died at the scene of the crash on the afternoon of New Year’s Eve 2010 when a drug-affected Palcak crashed into her car after failing to negotiate a bend and then over-steering his Jeep Cherokee on a highway at Moolort in central Victoria.

A broken bong was found in his car.

Palcak suffered multiple fractures in the crash and has since had 10 surgical operations.

The court heard he still bore emotional and physical scars – including a red scar that stretches across his shaved head – from the collision.

He suffers depression, anxiety, nightmares and post-traumatic stress disorder as well as minimal traumatic brain injury.

Palcak pleaded guilty to dangerous driving causing death, driving whilst impaired by drugs and using a drug of dependence.

The court heard from Palcak and several colleagues, friends and family members that he was a person of good character who was extremely remorseful and ashamed of what he had done.

It also heard of the impact Ms Wallis’ death has had on her son and brother and her sister, who has suffered nightmares, flashbacks and depression since losing her without having the chance to say goodbye.

Judge Susan Pullen said Palcak’s offending had impacted both his and the victim’s family.

“The facts in this case are extremely tragic,” she said.

“The distress caused to the family of Ms Wallis is palpable.

“I’m conscious, however, that I must not allow the overwhelming effect on the victims to swamp the sentencing process.

“Any sentence I impose will never, to them, be enough, as Ms Wallis’ family will need to live with the death of their mother or sister for the rest of their lives.”
