Crown bouncer to stand trial for assault

A Crown Casino bouncer threw a woman to the ground in an “excessive display of violence” out of proportion to any risk she posed, a Melbourne magistrate says.

Magistrate Peter Reardon has ordered Quoc Hai Tran, 34, to stand trial on assault charges for allegedly hurling Olivia Ferguson to the ground and pinning her down.

Ms Ferguson had slapped Tran, sparking a clash that led to the death of her friend Anthony Dunning at the casino on July 3 last year.

Mr Reardon told Melbourne Magistrates Court on Thursday CCTV footage of the incident showed Mr Dunning was clearly intoxicated. However, he, Ms Ferguson and her de facto partner Matthew Anderson, who was also with them, posed little real danger.

“The way (Ms Ferguson) is thrown to the ground is quite breathtaking,” Mr Reardon said.

“These (bouncers) are sober men sought to deal with patrons who are unruly. It was an excessive display of violence out of all proportion.”

Mr Dunning was being escorted from the casino when Ms Ferguson responded to a comment from Tran by slapping him.

Prosecutor Andrew Tinney SC said the slap “wouldn’t have harmed a fly” but Tran lashed out with excessive force.

“What he sought to do was take the opportunity to punish her,” Mr Tinney said.

He said Tran could have restrained her without excessive violence and was surrounded by bouncers who could have helped him.

Defence barrister Lachlan Carter countered that the slap was forceful and sudden, and that Tran did not have time for cool reflection.

Mr Anderson and Mr Dunning were also taken to the floor during the confrontation, with bouncer Matthew Lawson allegedly holding Mr Dunning in a choker hold.

Mr Dunning, 40, died in hospital four days later. Lawson, 27, of Hoppers Crossing is charged with his manslaughter.

Mr Reardon has ordered Tran to stand trial on a charge of common law assault for allegedly ordering Lawson to force Mr Dunning to the ground.

He is additionally accused of intentionally causing injury, recklessly causing injury, unlawful assault and common law assault in relation to Ms Ferguson.

The magistrate has not yet made a ruling on whether Lawson and four other bouncers will stand trial.

Jacques Tony Fucile, 30, Nicholas Vladamir Levchenko, 26, Cameron Paul Sanderson, 40, and Benjamin Michael Vigo, 24, are facing lesser charges variously relating to Mr Dunning’s assault and the incidents involving Mr Anderson and Ms Ferguson.
