Councillor told to stand down over criminal investigation

Logan councillor Hajnal Black will face criminal proceedings over allegations she failed to declare as a financial interest the joint bank account she shared with a man decades her senior.

The case is already at the centre of a civil hearing before the Supreme Court.

Today it emerged that Cr Black had also been summonsed to appear in the Beenleigh Magistrates Court next month over allegations she failed to inform the CEO of Logan Council that she held a joint bank account with the man, over whom she once held power of attorney.

In the civil matter, the Public Trustee of Queensland alleges Cr Black transfered $2.25 million from the sale of a property located in Park Ridge into the joint account she held with the 66-year-old man, despite the Office of the Adult Guardian suspending her capacity to act as the man’s power of attorney.

It is alleged she made numerous transactions from the joint account – including three to her own account – totalling $1.37 million from July 2009.

The revelation of criminal proceedings prompted calls from Logan Mayor Pam Parker for Cr Black to stand down.

“It is obvious Hajnal Black’s attention is now on personal matters and has been for some time now,” Cr Parker said.

“Staff and other councillors are carrying that workload …

“I believe, in the interest of serving the community and the integrity of the system of government, she should stand down immediately.

“If she chooses to do the honourable thing and stand down until these matters are resolved by the courts, I have asked the deputy major to carry the workload.”

The Public Trustee of Queensland – which has taken over as financial power of attorney and is now financial administrator for the man – is accusing Cr Black of inappropriately using his money for her own benefit.

However, Cr Black, who was disendorsed by the LNP in the seat of Wright in the 2010 federal election, has long maintained she had permission to spend the money in the joint account.

She has described the man as a father-figure, adding that their finances have always been linked.

Cr Black has also lodged a civil matter counter-claim against the Public Trustee, seeking the man’s home at Greenbank be signed over to her.

During a review of the civil proceedings in the Supreme Court today, Cr Black’s lawyers said they intended to request that the matter be stayed because of the impending criminal matter.

Justice Roslyn Atkinson listed the stay application for November 18, and asked both parties to provide material to the court by November 16.

Outside court today Cr Black said the criminal charges were a “surprise”, but declined to comment further as her husband Cr Sean Black hurried her past waiting media.

“I wish I could talk,” she said.

“I just can’t say anything right now.”
