Costa Concordia owners face multi-million pound lawsuit

When asked at which point Costa was aware of the extent of the disaster, he
replied: “Only when the signal to evacuate the ship was given.”

But Mr Schettino’s lawyer has insisted that the captain kept Costa informed of
developments on board, speaking to them three times before the official
evacuation began.

Mitchell Proner, a lawyer with Proner Proner, one of the US law firms
involved in the class action, said papers would be filed on Wednesday “on
behalf of all the victims” of the incident.

He said that claimants would be seeking compensation for continued medical
care, loss of earnings and the psychological effects of the evacuation.

The minimum claim would be £105,000 but some would be seeking up to £1
million, he said.

Mr Proner told the BBC that a civil claim would be launched against Mr
Schettino in Italy but he argued that the blame could not be pinned solely
on one man.

“It’s easy to say this captain acted alone,” he said.

“There are indications that there have been regular route deviations in
the past. There should have been safeguards on board; where were the alarms?

“At the time of the Titanic it might have been easy to say that radars
didn’t exist. Nowadays, with all the technology, it isn’t. There had to be a
failure in the system that allowed this to happen.”

Costa Cruises said it had already sent letters to all passengers asking them
to detail their expenses and any costs incurred as a result of the incident.

But Marco Ramadori, the president of Codacons, said the offer of a refund “as
if you had missed a plane and lost your luggage” was not good enough.

Cruise passengers are reported to have signed a contract when buying their
tickets that any potential litigation would be pursued under Italian law.

But Mr Proner said he was confident the US courts would accept the case.
