A STAR Group officer injured in an after-hours, interstate assault has won compensation for his disabilities.
Sgt Jason Wheeler was attending a training course at Mount Isa, Queensland, in 2009. On the night of the assault, he had socialised with colleagues at the Mount Isa Police Social Club until 11pm.
He was waiting to pick up a pizza on his way back to his motel when he was punched in the back of the head, suffering severe head injuries.
SA Police rejected Sgt Wheeler’s claim for compensation saying his disability did not arise in the course of employment. Sgt Wheeler, who had been with SAPOL for 13 years, took his claim to the Workers’ Compensation Tribunal and was yesterday granted compensation.
In his judgment, Deputy President Judge Peter Hannon said Sgt Wheeler had engaged in an altercation with a woman who was attacking him and while he defended himself, suffered a blow to the back of his head by a male.
He said Sgt Wheeler and others had been socialising at the Mount Isa Police Social Club earlier that night, following the end of the training program that afternoon.
Judge Hannon concluded that the injury arose in the course of his employment.
The amount of compensation is yet to be determined. SA Police have until Friday to appeal against the tribunal’s decision.
