Commonwealth progress on human rights hampered by lack of consensus

THE Commonwealth Heads of Government Meeting wrapped up in Perth yesterday with modest progress made on reform.

About half the 106 recommendations by the Eminent Persons Group designed to keep the Commonwealth relevant as an institution by enforcing basic values, were adopted or adopted in principle, while the rest were ignored or shelved.

The most urgent recommendation – the appointment of a commissioner for human rights, democracy and the rule of law – was rejected because of resistance from nations such as India, Sri Lanka and South Africa.

”Australia and a number of delegations indicated that they were supportive of this proposal, but there were a number of delegations concerned by it, and the Commonwealth is an organisation that involves consensus for its decision-making that works by consensus,” the Prime Minister, Julia Gillard, said.

In the communique released yesterday, the concept of the commissioner was referred for ”further evaluation” by the Commonwealth foreign ministers.

As a compromise, the leaders agreed to bolster the Commonwealth Ministerial Action Group, a revolving group of nine foreign ministers of member states.

The Eminent Persons Group said this was an inadequate compromise because the ministers, unlike an independent commissioner, would be hamstrung by political sensitivities.

Ms Gillard said the bolstered ministerial group was a significant advance given it had been rejected twice before by CHOGM and getting a consensus in an organisation as diverse as the Commonwealth was never easy.

One victory for was the adoption of a Charter of the Commonwealth, which contains principles espoused in all previous Commonwealth declarations.
