The City of Aiken, South Carolina (SC) and its Department of Public Safety are being sued by two residents of the state because of what the residents say was an illegal body cavity search in broad daylight.
The black couple, Elijah Pontoon and Lakeya Hicks, filed lawsuit because of their treatment by white police officers during a traffic stop in October 2, 2014. A complaint was filed the following day with the Department of Public Safety. According to the complaint, the couple was stopped for driving with a “paper tag”, a temporary license plate, on the car. This is completely legal in SC. The officer asked Hicks, the driver, to see a bill of sale for the car and asked Pontoon for identification. After these were studied, the couple was ordered out of the car and Pontoon was handcuffed.
According to the lawsuit, the officer said he was getting a police dog to check the car because of Pontoon’s “past history of dope”. Pontoon does have a record including drug charges prior to 2006. The officer reportedly said, “You’re gonna pay for this one, boy.” The car was searched with a sniffer dog.
The couple was searched without their consent. Hicks was searched off camera by a female officer and her breasts were exposed to a busy road and three male police officers. Pontoon was also searched off camera with a body patdown, then a three minute probe of his anus, where officers repeatedly hit his hemorrhoids, swearing it was drugs.
No drugs were found during the incident.
A statement was released in which the city denies the allegations. Other Officials say their officers were working within the course and scope of their job.
Both parties have agreed to a jury trial. Hicks and Pontoon are seeing actual, punitive and consequential damages as well as legal fees.
