An American sex offender branded a serious danger to the public by a police chief was yesterday jailed for 42 months.
John Nicoll, 29, was deemed such a risk that Tayside Police Chief Constable Justine Curran launched a groundbreaking legal action against him after he arrived in the UK.
Nicoll’s name had already been placed on the U.S. equivalent of the Sex Offenders’ Register for 30 years and Chief Constable Curran wanted his status to be automatically adopted in the UK.

But before the order came through, Nicoll carried out a sex attack on a 13-year-old girl after luring her to his home and plying her with alcohol. Nicoll, who fled Wake County, North Carolina, to live with his Scottish father in Perth, had been convicted in the U.S. of committing ‘indecent liberties with a child’ aged ten.
The pony-tailed pervert, who has a fascination for hard-core child porn, had just completed a jail term in North Carolina when he used his dual nationality to flee to Scotland at the end of 2008.
When Chief Constable Curran became aware that Nicoll was in Scotland she sought a unique legal ruling to have his U.S. sex offender status adopted in the UK. But Perth Sheriff Court heard yesterday that Nicoll subjected the girl to a horrific sex attack before the order was granted.
The court was told he enticed several under-age girls into his home in Perth in July 2009 and gave them alcohol.
None of the girls was aware he was a convicted paedophile. He attacked the youngest of the girls after her older friends left the room to be sick. It was only after the chief constable’s fears about Nicoll became public that the girl reported what happened to a relative and the police were informed in October 2010.
Nicoll admitted that in July 2009 at his home he sexually assaulted the 13-year-old. Charges involving two other girls were dropped by the Crown. He also admitted turning up at the court – which was also staging a High Court case – while armed with a lock knife. It was found by security staff last October 27.

Fiscal depute Alan Kempton said: ‘His conviction in North Carolina relates to burglary and indecent liberties. It refers to an offence involving a child who was ten years old. This current offence happened during the school holidays in 2009.
‘The complainer, who was 13, and her 15-year-old friends were in the accused’s house. They were all consuming alcohol.’
Sheriff Lindsay Foulis jailed Nicoll for 27 months for the sexual offence and a further 15 months for having the knife. He also made Nicoll subject to a further 27 months supervision after completing his jail term.
Nicoll was born to Scottish parents in Germany in February, 1982, and the family moved to North Carolina the following year. In 2003 his parents split up and his father returned to live in Scotland, while Nicoll remained in Wake County with his mother.
On March 15, 2005, Nicoll was convicted on a charge of ‘indecent liberties with a child’ at Raleigh Superior Court in his home state and jailed for between 19 and 23 months.
Perth Sheriff Court was told Nicoll had been assessed as posing a ‘very high risk’ to the public by social workers and psychologists.

The article does not state his nationality so, on the basis of the Australian decision to deport an offender back to UK as that was where he was born, can we send this guy back to Germany? Or don’t we do deportations? Has anyone been deported since the Lib Dems came to power (sorry, shared power)?

The police knew about this guy because of the details kept by the American authorities. How many countless individuals, with similar proclivities, have arrived in this country from Eastern Europe where no such information is exchanged with the police here? There are probably thousands like him. The sooner we have a referendum on our membership of the EU, the better. Once out of it, we can go back to saying who comes and goes from our country; and we won’t be required to tolerate the intolerable.

thank God for people like Justin Curran who understands the behaviour of these perverts, one only has to go to Wikipedia and click on “evil unveiled ” to see the amount of paedophile groups that are listed, and who openly practise and advertise their “freedom in sexual choce” , so glad I am not around long enough to see more of this acceptable behaviour

It’s about time dual nationality was scrapped, too many criminals are using it to evade justice. Under his USA passport he wouldn’t have been allowed to enter britian, and these girls would have been saved .
