Bail for woman accused of throwing dog

A WOMAN accused of throwing her puppy out of the window of her Kingswood apartment in western Sydney has been granted bail after she gave up the dog and promised not to own another.

Lily Maihi, 24, made her second court appearance yesterday after being charged on Tuesday for allegedly throwing her eight-month Ridgeback Staffordshire, Kyza, out of a window.

It is alleged the dog fell 15 metres onto concrete after being thrown during an argument Ms Maihi was having with a friend on Boxing Day.

The magistrate, Andrew George, said the claims made by police against Ms Maihi were ”particularly unpleasant” but his decision could not be based on the horrible nature of the offence.

He also could not take into account how many photos of ”doey-eyed puppies” were presented to the court.

Ms Maihi has been charged with torturing, beating and seriously injuring Kyza. The dog has undergone surgery.

In documents before the court, police allege that Ms Maihi appeared drunk when she got into a verbal fight with a friend, Adam Isaia, at the Park Avenue unit block.

The fight is alleged to have started after Mr Isaia questioned why Ms Maihi had not been cleaning up the dog’s faeces on the balcony.

Ms Maihi is then alleged to have carried Kyza to her bedroom and used two hands to throw the dog out of the window.

As the accusations were outlined against her, Ms Maihi, who appeared via video link, repeatedly shook her head denying the claims.

Her lawyer told the court the case had attracted a large amount of media attention and that because the victim was a young puppy it prompted a ”certain emotional response” from the public.

But, he said, the court which ultimately heard the case would not base its judgment on ”how cute” the dog might be.

He said Ms Maihi would never see Kyza again and he had signed papers on her behalf surrendering it for release. The case has been adjourned to Penrith Local Court on January 18.
