A win for clean air, hopes for having a stable climate, and common sense itself: The US Court of Appeals for the District of Columbia has unanimously ruled that the EPA does indeed have the authority to regulate carbon pollution under the Clean Air Act, Reuters reports.
NRDC senior attorney David Doniger said the rulings “clear the way for EPA to keep moving forward under the Clean Air Act to limit carbon pollution from motor vehicles, new power plants, and other big industrial sources.”
Former EPA head in the Clinton administration and former director of the White House Office of Energy and Climate Change Policy under President Obama, Carol Browner commented:
The Court’s decision should put an end, once and for all, to any questions about the EPA’s legal authority to protect us from industrial carbon pollution through the Clean Air Act. This decision is a devastating blow to those who challenge the overwhelming scientific evidence of climate change and deny its impact on public health and welfare. (Climate Progress)
I’m not sure it will really put an end to challenges to regulating carbon pollution, or the EPA’s authority to do so, but it is certainly encouraging.
