‘Ahmadinejad letter against Constitution’

“According to Article 113 of the Iranian Constitution, the president cannot send cautionary notes to the Guardian Council or any bodies that are not under the three branches of the government,” Abbas Ali Kadkhodaei said on Tuesday.

The Article 113 of the Iranian Constitution states that the president is tasked with implementing the Constitution and acting as the head of the executive, except in matters directly concerned with the Leader.

Therefore, the letter of the president regarding a law that allows overseeing [the conduct] of Majlis lawmakers is in violation of the Article 113 of the Constitution, Kadkhodaei added.

Iran’s Majlis Speaker Ali Larijani recently notified the government of the law after it was passed by the lawmakers and approved by the Guardian Council, which is tasked with ensuring that the laws passed by the parliament are in accordance with Islamic law.

In a letter to Ayatollah Mahmoud Shahroudi, who is the chairman of a special body tasked with arbitrating disagreements and regulating relations between the three branches of the government, Ahmadinejad said that the law was discriminatory and in violation of certain articles of the Constitution.
