The relative accused of murdering five members of the Lin family in Sydney will attempt to make bail before Christmas.
Lian Bin “Robert” Xie, 47, has been in custody since May this year after he was charged with the July 2009 murders.
Xie was transferred to Sydney’s Central Local Court on Thursday in anticipation of a bail application his barrister Graham Turnbull, SC, had prepared.
But the matter required an estimated two hours to be heard, which the court determined was not available until next week.
Xie’s brother-in-law, 45-year-old Min “Norman” Lin, and sisters-in-law, Yun Li “Lily” Lin, 43, and Yun Bin “Irene” Yin, 39, as well as two boys aged nine and 12, who cannot be named for legal reasons, were found beaten to death more than two years ago.
They are survived by a teenage girl who was 16 at the time of the deaths and was overseas on a school trip. She cannot be named for legal reasons.
Their bodies were found in a house at North Epping, in Sydney’s northwest, on July 18, 2009, after Mr Lin failed to open his newsagency that morning.
After a lengthy investigation, police charged Xie with the murders.
He has declined to appear at all previous court appearances but will appear via audio-visual link on December 22, when he applies for bail in the same court.
On Thursday, Mr Turnbull told the court that a relative had travelled from overseas to post a surety bond if Xie was granted bail.
